1. Agreement

These Terms are an agreement between you and Alper Kayabaşı, an individual developer based in Istanbul, Türkiye (“we”, “us”), and govern your use of the Musiva mobile app (the “App”) and the website musiva.studio (together, the “Service”). By downloading or using the App you accept these Terms. Our Privacy Policy explains how we process personal data.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian.

2. App licence and Apple’s Standard EULA

The App is licensed to you, not sold. If you obtained the App from the App Store, your licence to use it is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms supplement the Standard EULA. If they conflict on your licence to use the App, the Standard EULA prevails; otherwise these Terms apply.

3. Your account

  • The App does not ask for your email, name or a password. Each installation signs in automatically with an anonymous account.
  • The App shows you a reference number called your Musiva ID, for support. It is not a password and does not give access to your account.
  • If you delete the App or change devices, you lose access to that anonymous account. Its songs, your credit balance and your pack credits cannot be recovered or moved to a new account.
  • An active App Store subscription can be restored to a new Musiva account with Restore Purchases in the App. The subscription, and the subscription credits granted after it is restored, then belong to the new account.
  • You can delete your data at any time with Settings → Delete My Data. What is deleted and what is kept is described in the Privacy Policy.

4. Musiva Premium, credits and purchases

Free first creation

Your first creation is free. You can listen to one song from it; if a second version was created, it unlocks with a subscription.

Credits

Each delivered song uses 1 credit. Before you create, the App shows how many songs the creation will produce and how many credits it needs.

Musiva Premium subscriptions

  • Weekly: 20 credits each week.
  • Monthly: 80 credits each month.
  • Yearly: paid once a year; 80 credits at purchase and then 80 credits each month, not all at once.

Unused subscription credits expire at the end of the period they were given for and do not carry over.

Credit packs

Active subscribers can buy one-time packs of 120, 300, 500 or 1,000 credits. Pack credits do not expire, but if you lose your account (by deleting the App or changing devices), they cannot be recovered or moved to a new account.

Credit rules

Credits cannot be transferred, have no cash value and are not refundable. This does not affect Apple’s refund processes.

Payment, renewal and cancellation

  • Payment is charged to your Apple Account when you confirm the purchase. Payments, renewals, cancellations and refunds are handled by Apple.
  • Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the current period ends.
  • You can manage and cancel your subscription in your App Store account settings. Deleting the App or your data does not cancel a subscription.
  • Prices vary by country and are shown in the App before you buy.

5. Your content and acceptable use

You are responsible for making sure that the lyrics and other text you enter are yours or that you have the right to use them. You allow us to store your input and send it to our music generation providers only to provide the Service.

You must not use the Service to create or submit content that infringes the rights of others, is hateful or harassing, or is illegal. You must not attempt to disrupt the Service or get around its credit or payment rules.

6. AI-generated songs and your rights

  • Songs are generated by artificial intelligence. Results may not always meet your expectations and may resemble other works.
  • The vocal preference (female, male or any) is a request, not a guarantee.

Use of songs

You may use songs you create with Musiva for personal, non-commercial purposes, including sharing them privately and on your personal social media accounts without monetisation. Commercial use, such as selling songs, distributing them to streaming services or using them in advertising or monetised content, is not permitted. We do not guarantee that songs are free of third-party rights or that they can be protected by copyright.

7. Availability and changes

The Service depends on third-party providers, including AI music generation, infrastructure and Apple. It may be interrupted or unavailable at times, and its features may change.

8. Our rights

The App, the Musiva name and logo and the design of the Service belong to us. These Terms give you no rights to them other than the right to use the Service as described here.

9. Disclaimer and limitation of liability

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind.

To the extent permitted by law, we are not liable for indirect or consequential damages or for loss of data or content, and our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intent or gross negligence, or your rights under mandatory consumer protection law.

10. Termination

You can stop using the Service at any time and delete your data with Settings → Delete My Data. We may suspend or end your access if you break these Terms. When your access ends, your licence to use the App ends. Sections that by their nature should continue to apply will survive.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Subject to the following sentences, disputes are subject to the courts and enforcement offices of Istanbul (Merkez/Çağlayan). If you are a consumer, this does not affect your right to apply to the consumer arbitration committees or consumer courts that are competent under mandatory law, including those at your place of residence. If you are a consumer living in the European Union, the European Economic Area or the United Kingdom, you also keep the protection of the mandatory law of your country of residence and may bring claims in the courts there.

12. Terms relating to Apple

If you obtained the App from the App Store, the following also applies:

  1. Acknowledgement. These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content. These Terms do not provide usage rules that conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. Your licence is a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; the App may also be used by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. We are solely responsible for providing maintenance and support for the App, as stated in these Terms or required by law. Apple has no obligation to provide any maintenance or support for the App.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are our responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
  6. Intellectual property. If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer name and contact. Questions, complaints or claims about the App should be sent to: Alper Kayabaşı, Istanbul, Türkiye; email support@musiva.studio.
  9. Third-party terms. You must comply with applicable third-party terms when using the App, for example your mobile data service agreement.
  10. Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

13. Changes to these Terms

We may update these Terms. We will publish the new version on this page with a new effective date and, where the law requires it, inform you by other appropriate means. If you keep using the Service after the changes take effect, you accept the updated Terms.

14. Language

These Terms are written in English and translated into other languages for your convenience. If the English version and a translation differ, the English version prevails.
